How Can Our Student Immigration Lawyers Assist You

Applying for a student visa can be a confusing and tedious task, which is why you need the services of a student visa lawyer. Such a lawyer will be a critical resource as they will provide you with additional information and help make the process as smooth as possible.

Moreover, it has been shown that working with an Atlanta student immigration lawyer makes your visa more likely to be approved than if you went through the process on your own. The thing about student visa attorneys is that they are knowledgeable on the different student visas and the eligibility requirements for each. They will handle any problems that may arise during the application process.

Types of Student Visas Our Student Immigration Attorneys Can Help With

There are three different types of visas that you can apply for when coming to the United States as a student. These include the F visa, the J visa, and the M visa.

Before international students apply for any type of student visa, they have to be accepted by the U.S. institution of higher education. The educational institution must be certified by the Student and Exchange Visitor Program (SEVP). Only SEVP-certified schools can enroll foreign students with F or M student visas and issue them a Form I-20.

The F Visa

This student visa is intended for international students who intend to pursue an academic degree at an American university or U.S. college. You may also qualify if you intend to study English at an intensive English language institute or university.

The F visa usually includes:

  • F-1 student visa for a full-time student
  • F-2 visas for dependents of F-1 visa holders that may include spouse and unmarried children younger than 21
  • F-3 visas for border commuters – These include students from Canada and Mexico who study from their home countries but attend full-time or part-time school in the U.S.

Foreign students holding an F 1 student visa can remain in the US up to 60 days after the program end date listed on Form I-20. However, the F-1 student visa allows one to work under the authorization of the U.S. Citizenship and Immigration Services (USCIS).

Eligible students can receive up to a year of Optional Practical Training, temporary employment related to their major area of study, before or after they have graduated from their academic program.

The M Visa

This is a student visa for an international student applicant who intends to engage in vocational or non-academic training or study at American institutes. The three types of M visas include:

  • M-1 visa for immigrant students engaging in non-academic or vocational studies
  • M-2 visas for dependents of  M-1 visa holders
  • M-3 visas for border commuters, which offers similar privileges to the F-3 visa

M-1 visas allow students to live in the U.S. for a fixed period, usually the length of their optional practical training or vocational study. They are usually not allowed to work on or off-campus and may not change their student status to F-1 visas.

The J Visa

This is intended for international exchange students in the U.S. to participate in cultural exchange programs. The programs may include but are not limited to teaching, medicine, and business. These are usually government programs or private sector-sponsored students who meet the eligibility criteria set out.

Holders of this student status can usually stay in the United States for one or two semesters. They will usually have to return to their home country for at least two years after their exchange visitor program expires.

If you intend to apply for a student visa, an immigration law firm Manji Law P.C. has lawyers with extensive understanding and experience in immigration, including the different requirements for the student visas available. Our office may just be able to help you get your visa approved, inform you what visa you are eligible for, and provide any assistance you may need.

You Need the Best Student Immigration Lawyer

Nobody can deny the importance of a student visa attorney when you are looking to obtain a foreign student visa.

Given how much complexity you will have to wade through, you will require the assistance and advice of a lawyer who understands the requirement criteria by Homeland Security and, sometimes, the criteria of the schools you are applying to.

Moreover, each visa, embassy, and consulate has regulations and rules that must be adhered to before an application is approved or moves forward. Some of the requirements that an applicant has to adhere to include:

  • Full enrollment in an accredited school
  • Enrollment in an academic education department rather than a vocational program
  • The institution one is applying for needs to be on the schools’ list approved by the U.S. Citizenship and Immigration Services (USCIS)
  • A residence abroad that will have to be maintained throughout the applicant’s study
  • Proficiency in English or be accepted into a program, where they will gain proficiency in English
  • Sufficient funds to support themselves as they pursue their studies

  • Are experienced or skilled in the type of issue you have
  • Charge an hourly or flat rate fee
  • Can give you an estimate of the cost
  • Can provide an estimate of the amount of time it would take

How to Choose a Lawyer

When you first speak with a lawyer about your immigration issues, some of the things to take into account include:

  • How effective is their communication – are they straightforward in their communication?
  • Do they have reasonable fees as compared to their competition?
  • Do they provide a clear explanation of how they will communicate progress regarding your case?
  • Will they keep confidential or sensitive information private?

Only when you are satisfied and have understood the legal contract should you sign up with them.

Hire Immigration Lawyer for Students

If you are looking for a student visa but are debating where to hire a student visa lawyer, you should know that technically you do not have to hire one.

Having an attorney usually improves your chances of getting approved, but it does not guarantee that your application will be approved. Given the complex procedures, you would be doing yourself a disservice by not working with an attorney.

Why You Should Hire a Student Visa Lawyer

When you are applying for the F-1 visa, otherwise known as the student visa, it is critical to hire an attorney for the following reasons:

It is common for the Department of Homeland Security to deny one’s application even when meeting all other requirements. As long as one is deemed inadmissible, one may be denied.

For instance, a person with a criminal record back home may be deemed ineligible. Applying to schools that may not be approved by the SEVIS system at the Department of Homeland Security could also result in an application being denied.

By working with an immigration attorney from Manji Law P.C., you will get the advice you need to file your application correctly. We may try to figure out if the school or program you have applied to is on the approved list of schools by the DHS. We may also check your qualifications to determine if you meet the admission requirements for that school.

Contact us today if you intend to embark on the student immigration process, and we may be able to provide you with guidance and legal advice on the application process. We may also help you accurately fill out the necessary documentation to improve your application’s chances of getting approved.

What Immigration Student Visa Should You Apply For?

If you intend to study in the United States, you may apply for a particular student visa depending on your circumstances. The three main types of visas you can apply for include the F visa, the M visa, and the J student visa.

Overall, the F student visa is one of the easiest to get approved for because the requirements are pretty much straightforward. All you will need to prove is that you are heading to the U.S. to pursue academic studies at one of the DHS-approved academic institutions.

One of the most important things to note is that you will need to be admissible to the U.S. just like any other immigrant to stand a chance of getting your application granted. Apart from admissibility, other requirements will vary depending on the visa you are eligible for.

If you intend to attend an American university and are looking for a student visa, you should secure the services of an experienced student visa lawyer.

The attorneys at the office of Manji Law P.C. have the necessary skills and experience in immigration law to help you with any challenges you may have. We have helped many immigrant students to submit their documentation and successfully get their applications approved.
